The petitioner is accused in connection with Special Case No. 5888 of 2018 arising out of Didarganj P.S. Case No. 102 of 2018 registered under Section 30(a) of the Excise Act. The accusation is that in course of patrolling duty, informant being the police officials received the information about concealing and selling the illicit liquor at Mahabir Ghat, Didarganj by Santosh Sah, Sanjay Kumar, Ranjit Rai and the petitioner then informant reached there and on seeing the police party, some persons succeeded to flee way. On search, 633 pouches each containing 200 ml, 40 litres kept in rubber tube, 20 litres kept in three plastic Gallons country made liquor were

Patna High Court Cr.Misc. No.62291 of 2018(2) dt.06-10-2018 2/2 recovered. The people, who present there, disclosed the name of petitioner and three others about concealing and selling of aforesaid liquors.

Learned counsel for the petitioner submits that petitioner was not apprehended at the spot rather his name has come in the F.I.R. only mere on suspicion. It is further submitted that petitioner has no criminal antecedent and he is in custody since 01.08.2018.

Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Special Judge, Excise, Patna, in connection with Special Case No. 5888 of 2018 arising out of Didarganj P.S. Case No. 102 of 2018. Out of two sureties, one surety must be the close relative of the petitioner.
