NILU AGRAWAL ORAL ORDER 22-11-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is languishing in custody since 12.08.2016 in a case registered for the offences punishable under Sections 272, 273, 290 and 34 of the Indian Penal Code and under Section 47 (A) of the Bihar Excise ( Amendment) Act, 2016. The prosecution case as lodged by the informant, Vikash Tiwari , S.H.O., Mehasi P.S. is that when he was on duty, he received secret information that four persons were coming from Motorcycle with wine and after that he along with other police officials reached at Mahendra Chowk. In the meantime, two motorcycles were coming from Muzaffarpur and seeing the police party they tried to flee away but apprehended by the police party and disclosed their name with address and recovered mobiles, two

Patna High Court Cr.Misc. No.50077 of 2016 (2) dt.22-11-2016 2/2 motorcycles and 24 bottle English wines of 375 ML and the seizure list was prepared.

It has been submitted by the learned counsel for the petitioner that he is innocent and has been falsely implicated due to ulterior motive. He submits that there is no criminal history and small quantity of liquor was confiscated by the police. However, learned A.P.P. for the State submits that the petitioner is named in the F.I.R., hence, opposes the prayer for bail.

Be that as it may, considering the period of custody, let the above named petitioner, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate- VI, Motihari, East Champaran in connection with Mehshi P.S.Case No. 126/2016.
