The petitioner seeks bail in Bounsi P.S. Case No.316 of 2017, registered under Sections 399 and 402 of the Indian Penal Code as well as under Sections 25(1-b)a, 26/35 of the Arms Act.

The police on receiving information about the preparation of committing dacoity raided the place and apprehended Mukesh Kumar Yadav and others and from their possession arms and ammunition were recovered. Name of the petitioner figured in the case in the disclosure made by the apprehended accused. Initially only five accused persons were apprehended and the apprehended accused disclosed the name of other five persons including the petitioner Prabhash Yadav but nothing has been recovered from possession of the

Patna High Court Cr.Misc. No.61409 of 2018(2) dt.06-10-2018 2/2 petitioner. The petitioner is in jail since 23.04.2018. Petitioner has already remained in jail for more than 51⁄2 months. Considering the facts aforesaid, petitioner, above named, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-III, Banka in connection with Bounsi P.S.
