Mr.Shailendra Kumar Singh, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE PURNENDU SINGH ORAL ORDER 29-01-2025 Heard Mr. Ashok Kumar, learned counsel appearing on behalf of the petitioners and Mr. Shailendra Kumar Singh, learned counsel for O.P.No.2.
2. Petitioners seek pre-arrest bail in connection with Jehanabad Town P.S.Case No.327 of 2023, registered for the offences punishable under Section 406, 420, 506 and 120(B)/34 of the Indian Penal Code.
3. Learned counsels of both the parties have jointly informed that today they have received instruction from their respective parties that they are ready to resolve their dispute amicably and the petitioners are ready to return the amount of
Patna High Court CR. MISC. No.56991 of 2024(5) dt.29-01-2025 2/3 Rs.3,34,100/- to O.P.no.2, as claimed by him. It is further informed that the agreed amount will be paid by the petitioners within a period of two weeks from the date of communication of this order.
4. Considering the information given on behalf of the petitioners, I find that the intention of the petitioners is not to engage in fraud or any cheating rather they are ready to return back the amount. The petitioners have prima facie made out a case to be released on pre-arrest bail.
5. Learned APP for the State has vehemently opposed the prayer for grant of pre-arrest bail to the petitioners.
6. Having considered the rival submissions made on behalf of the parties, as well as, the petitioners are ready to return the amount and resolve the dispute amicably, the petitioners are directed to be released on pre-arrest bail, in the event of their arrest or surrender before the learned district court within a period of four weeks from today, on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M. Jehanabad/concerned court, in connection with Jehanabad Town P.S.Case No.327 of 2023 (Jehanabad P.S.Case No.327/2023), subject to conditions as laid down under Section
Patna High Court CR. MISC. No.56991 of 2024(5) dt.29-01-2025 3/3 438(2) of the Cr.P.C.
7. The learned district court is directed to verify the criminal antecedent of the petitioners and if it is found that the petitioners are involved in some other cases as what has been stated in paragraph No.3 of the bail application, this order will automatically lose its force.
