JUSTICE SUDHIR SINGH ORAL ORDER 22-09-2015 Heard learned counsel for the petitioner and the State. The petitioner is apprehending her arrest in a case instituted under Section 302/34 of the Indian Penal Code and Section 27 of the Arms Act.
It is alleged by the informant that one Manoj Kumar collecting brick at his door. The accused Abhay Kumar @ Munna object and as a result of which an altercation took place. In the meantime, co-accused Rajesh Kumar, Arti Kumari, Amar Kumar Saxena, Ajay Kumar and Most. Chandra Kala Devi told to kill him. Then this petitioner brought pistol from her house and shot at the right chest of Manoj Kumar who fell down. The persons nearby assembled there and brought injured to Sadar hospital where the doctor declared him dead.
Patna High Court Cr.Misc. No.25612 of 2015 (3) dt.22-09-2015 It has been submitted on behalf of the petitioner that petitioner has got no criminal antecedent. It has also been submitted that the petitioner is a teacher in the Prakhand school. She has falsely been implicated in the present case. The main allegation is against one Abhay Kumar alias Munna who is said to have shot at the deceased. Petitioner is a lady. No injury has been attributed against her.
It has been submitted on behalf of the State that the petitioner is named in the FIR.
Considering the aforesaid facts, let the above named petitioner, in the event of her arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Khagaria in connection with Beldaur P.S.Case No.88 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
