JUSTICE SUDHIR SINGH ORAL ORDER 11-01-2017 Heard learned counsel for the petitioners and the State. The petitioners seek bail in a case instituted for the offences under Sections 121(A), 122, 124(i), 149, 414 of the I.P.C. as well as Sections 4, 5 of the Explosive Substance Act and Sections 16, 18, 20, 23 of the U.A.P. Act.

Earlier the bail application of the petitioners was rejected vide Annexure-1 to the present application with a direction to the trial court to conclude the trial preferably within a period of nine months from the date of receipt of the order. A report was called for from the trial court, which is at Flag 'G'. It has been reported that the charge has been framed. It has been submitted on behalf of the petitioners that the petitioners are in custody since 21.2.2015 i.e. for

Patna High Court Cr.Misc. No.53277 of 2016 (3) dt.11-01-2017 2/2 approximately 23 months and the trial has not progressed. There is no direct or indirect evidence against the petitioners. On behalf of the State, it is submitted that the petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances, it is directed that the petitioners above named be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Munger in connection with Sessions case No.220 of 2016 arising out of Kharagpur (Gangta) P.S. case No.47 of 2015.
