JUSTICE RAJIV ROY ORAL ORDER 13-01-2023 Heard learned counsel for the petitioner and learned APP for the State in Virtual Court Proceeding. Let the defect(s), if any, as pointed out by the office, be removed within four weeks.

The petitioner is apprehending arrest in connection with Bachhwara P.S. Case No. 47 of 2022 under section 366(A), 308/34 of the Indian Penal Code.

As per the FIR, this petitioner along with Aditya Kumar and Raju Kumar lifted the minor girl on a Scorpio and fled away. When this was complained to the family members, it is alleged that they were also assaulted.

Taking into account the aforesaid facts that the allegation against the petitioner is of kidnapping of minor girl along with two other accused, this Court is not inclined to grant

If the petitioner surrenders within a period of four weeks from today, the concerned Court shall take up the matter and dispose of expeditiously without being prejudiced by the observation made herein.
