Petitioner seeks bail in a case registered for the offences punishable under Sections 399, 402, 414 and 34 of the Indian Penal Code and Section 3⁄4 of the Explosive Substances Act. On information that some miscreants are preparing to commit dacoity, the police committed raid and arrested three persons whereas three escaped from the scene. The petitioner was also arrested and from his possession some material for preparation of explosives were recovered. Submission of the petitioner is that he is in custody since 23.09.2014 and co-accused Dilip Singh has already been allowed bail by a co-ordinate Bench of this Court in Cr. Misc. No. 14178 of 2015. Allegation against Dilip Singh was of

Patna High Court Cr.Misc. No.1671 of 2017 (3) dt.07-03-2017 2/2 recovery of firearm and cartridges.

Considering the facts and circumstances, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned 1st Additional Sessions Judge, Siwan/successor Court in connection with Sessions Trial No. 267 of 2015 arising out of Bhagawanpur Police Station Case No. 225 of 2014, with same conditions regarding cancellation of bail etc. which has been imposed in respect of Dilip Singh.
