JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 21-05-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. This is an application seeking anticipatory bail in a case registered for the offences punishable under sections 341, 323, 376, 511/34 of the Indian Penal Code and Section 3(i)(x)(xi)/2(v) of the S.C./S.T. Prevention of Atrocities Act. Learned counsel for the petitioner has submitted that no offence under section 3(i)(x)(xi)/2(v) of the S.C./S.T. Prevention of Atrocities Act is made out in the facts and circumstances of the case as the occurrence is not said to have taken place in public view. She further submits that false allegation has been made against the petitioner because of some dispute relating to payment of wages.

Patna High Court Cr.Misc. No.11220 of 2015 (3) dt.21-05-2015 Considering the submission of the learned counsel for the petitioner, let the petitioner above named, in the event of arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Siwan in connection with Siwan SC/ST P.S. Case No. 52 of 2013, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure, 1973.
