The prosecution case, in brief, is that the petitioner and her husband Premlal Mandal fed poisonous sweets to the wife of the informant, namely, Bega Devi, due to which, she died.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 26.07.2022. She has got no criminal antecedent. Charge sheet has been submitted in the present case. There is no allegation of tampering with the witnesses alleged against the petitioner. The petitioner has been made accused in the present case due to land dispute between the parties. The deceased is the sister-in-law (Gotani) and also own sister of the petitioner. Cognizance has been taken under Section 306 of the I.P.C. There is no circumstantial evidence to show that the petitioner is an abettor.
On behalf of the State, it is submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances of the case, the petitioner, above-named, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-Ist, Banka, in connection with
