The petitioners have prayed for regular bail in a case registered for the offence punishable under sections 341, 323, 506, 504, 379, 324, 326, 354B, 34 of the Indian Penal Code. Allegation against the petitioners is that they along with co-accused persons assaulted to the informant by means of sword due to which he sustained three cut injury between index and middle finger of the hand and also snatched cash of Rs. 2,500/-.

Learned counsel for the petitioners submits that the petitioners are innocent and have committed no offence. A land

No.52500 of 2022(2) dt.16-01-2023 2/2 dispute going on between informant and the petitioners and both parties are in litigating term due to which the petitioners have falsely been made accused in this present case. As per the impugned order, the injury sustained to injured by hard and blunt substance which does not in-consonance with prosecution story. It is further submitted that the petitioners are languishing in judicial custody for more than six months. Learned APP appearing for the state has vehemently opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioners on bail. The above named petitioners are directed to be released on bail in connection with Laheri P.S. Case No. 51 of 2022 on furnishing bail bond of Rs.10,000/- (ten thousand) each of them with two sureties of the like amount each to the satisfaction of learned A.C.J.M.,-V, Biharsharif, Nalanda.
