JUSTICE SUDHIR SINGH ORAL ORDER 24-10-2016 Heard learned counsel for the petitioner and the State. The petitioner is in custody in a case registered under Sections 341, 323, 307, 504, 506/34 and 302 of the Indian Penal Code.

The allegation against the petitioner and other coaccused is of assaulting the informant brutally with danda and fists. On information his nephew Sunil Sharma came there and in injured condition he was brought to Sadar Hospital, Gopalganj for his treatment. Thereafter on 25.3.2016 his uncle died It has been submitted on behalf of the petitioner that the petitioner is in custody since 06.06.2016. Charge sheet has been submitted in this case. The petitioner has got no criminal antecedent. There is no allegation of tampering with the witnesses

Patna High Court Cr.Misc. No.35476 of 2016 (3) dt.24-10-2016 2/2 alleged against the petitioner. Four persons are named in the FIR. The petitioner is not named in the FIR. The informant is the deceased of the case, who is said to have subsequently died in course of treatment. Later on, the nephew of the informant (deceased) is said to have named this petitioner in the present case. Except that there is no other material to suggest the implication of the petitioner in this case.

On behalf of the State, it has been submitted that the petitioner is not named in the FIR. His name has come in course of investigation.

Considering the facts and circumstances of the case, let, above named petitioner, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Gopalganj in connection with Gopalganj (Town) P.S.Case No. 121 of 2016.
