This is an application for grant of anticipatory bail in connection with Azamnagar P. S. Case No. 282 of 2016, disclosing offences under Sections 364, 365, 34 of IPC. As per F.I.R. brother-in-law of the informant had gone out of the State along with one Bishan Mandal and Prakash Mandal for earning purpose. After sometime, both the persons returned but the brother-in-law of the informant has not returned and on query Prakash Mandal has threatened the informant of dire consequences. He has suspects that he has been killed by the petitioner.
Submission of the learned counsel for the petitioner is that the case has been lodged after one year and even according

No.48395 of 2019(3) dt.15-11-2019 2/2 to the F.I.R. the alleged victim has gone along with his wife, but no F.I.R. has been lodged by his wife, but later on, name of the petitioner transpires during the investigation. It has also been submitted that investigation has also disclosed that the deceased was hard core criminal and as such, he has been killed and murdered by someone.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned C.J.M. Katihar, in connection with Azamnagar P. S. Case No. 282 of 2016, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
