JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 23-12-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends her arrest in connection with Kishanpur P.S. Case no. 175 of 2015, registered under Sections 341, 376, 504 and 506 of the Indian Penal Code and Section 4 of the POCSO Act, 2012.

The accusation is that Pradeep Kumar, son of the petitioner, committed rape at three years old grand daughter of the informant. When informant having known about the incidence of rape to her grand daughter went at the door of the petitioner for making complaint then petitioner and his son abused him. Learned counsel for the petitioner submits that, in fact, petitioner being the mother of co-accused Pradeep Kumar against whom allegation has been made to commit rape upon minor grand daughter of the informant, has been falsely been implicated in this

Patna High Court Cr.Misc. No.55346 of 2016 (2) dt.23-12-2016 2/2 case. The petitioner is a lady and has no criminal antecedent. Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of her arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Judicial Magistrate, 1st Supaul in connection with Kishanpur P.S. Case No. 175 of 2015, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
