This application for regular bail arises out of Ekma P.S. Case No. 306 of 2019, disclosing offence punishable under Sections 395 and 397 of the Indian Penal Code. The petitioner's prayer for bail was earlier rejected by this Court by order dated 05.03.2021 passed in Cr. Misc. No. 36223 of 2020 with a liberty to the petitioner to renew his prayer for bail after six months, if in the meanwhile there was no substantial progress at the trial. This application has been filed renewing the prayer for bail.
Learned counsel appearing on behalf of the petitioner has submitted that except for framing of the charge, there is no
Patna High Court CR. MISC. No.62815 of 2021(8) dt.11-05-2022 2/2 progress at all at the trial. He has further submitted that in similar circumstance, co-accused Vishwajeet Kumar Sah has been allowed regular bail by an order dated 17.11.2021 passed in Cr. Misc. No. 23570 of 2021. He has also submitted referring to the said order dated 17.11.2021, passed in case of Vishwajeet Kumar Sah, that co-accused Rajesh Pandit and Abhisek Tiwari have also been allowed regular bail by this Court. Considering the submission that similarly circumstanced co-accused have been allowed bail by this Court, this application is allowed.
Let the petitioner, above-named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand Only), with two sureties of the like amount, each to the satisfaction of learned Additional Chief Judicial Magistrate-I, Saran at Chapra in Ekma P.S.
