Petitioner seeks bail in Ghorasahan P.S. Case No. 380 of 2014 for the offences punishable under Sections 365, 368, 372/34 of the Indian Penal Code.
It is alleged in the written report that the daughter of the informant was married with this petitioner. She was found missing. The informant has alleged that this petitioner and other accused have either confined or sold his daughter.
It has been submitted on behalf of the petitioner that in the supplementary case diary in paragraph
Patna High Court Cr.Misc. No.40719 of 2016 (7) dt.11-05-2017 2/2 no. 17, it has come that the girl eloped with a boy. From the impugned order, it appears that the petitioner is in custody since, 28.03.2016. Learned APP has submitted that other witnesses in their statement have raised mere suspicion against the petitioner.
Considering the above facts and keeping in view the period of custody, this petition for bail is allowed and the petitioner named above, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Ghorasahan P.S. Case No. 380 of 2014 to the satisfaction of learned Sub Divisional Judicial Magistrate, Sikrahana at Dhaka subject to the condition that both the bailors should be close relatives of the petitioner.
