JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 01-03-2017 It is informed by Mr. Anjani Kumar, learned Senior Counsel, appearing on behalf of Bihar State Food Corporation, that an application has been filed before the learned Sessions Judge, Nalanda, at Biharsharif, for cancellation of bail granted to Opposite Party No. 1, which is presently pending in the Court of learned Additional Sessions Judge VI, Nalanda, at Biharsharif. It has further been informed that another application has been filed before the Court of learned Chief Judicial Magistrate, Nalanda, at Biharsharif, raising a grievance that the

Patna High Court Cr.Misc. No.5350 of 2017 (5) dt.01-03-2017 2/2 Opposite Party No. 1 is not complying even with the condition of the bail.

Since an application for same relief is pending in the learned Court below under same provisions of law, learned Senior Counsel seeks permission to withdraw this application.

This application is accordingly dismissed as withdrawn, with the observation that the withdrawal of this case shall not be prejudice the case of the parties in any manner whatsoever in the proceeding before the learned Court below.
