The petitioner seeks bail in Rajiv Nagar P.S. Case No. 193/2016, registered for the offences punishable under Sections 420 and 379 of the Indian Penal Code.

The informant alleged that two persons came and requested his wife to see some books. They started cleaning ornaments, but in the meantime both accused fled away with the ornaments.

Learned counsel for the petitioner submits that the petitioner was arrested on 19.10.2016 and from his possession different articles were recovered. No theft article was recovered from the possession of the petitioner. It is further submitted that

Patna High Court Cr.Misc. No.55644 of 2016 (3) dt.02-03-2017 2/2 similarly situated co-accused Mantun Kumar has already been enlarged on bail vide order dated 09.01.2017 passed in Cr. Misc. No. 55679/2016.

Considering the facts aforesaid, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Patna in connection with Rajiv Nagar P.S.
