The petitioner apprehends his arrest in Excise Case No.345 of 2019 registered under Section 30(a) of the Bihar Prohibition and Excise Act.

The excise official alleged that the petitioner fled away after throwing the bag containing bottles of Indian made foreign liquor.

Learned counsel for the petitioner submits that the petitioner has falsely been implicated in the case. Nothing has been recovered from possession of the petitioner. The bag was found by the side of the road and the petitioner on account of some dispute has been implicated in the case. Having considered the facts aforesaid, the above

No.48662 of 2019(2) dt.05-08-2019 2/2 named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge VI, Kaimur, Bhabua in connection with Excise Case No.345 of 2019, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
