Petitioner seeks bail in a case registered for the offences punishable under Section 304B/34 of the Indian Penal Code.

Petitioner is husband of the victim of dowry death. Petitioner is in custody since 31.05.2015.

Earlier prayer for bail was refused on 15.11.2016 with direction to the Trial Court to examine the prosecution witnesses within eight months. The report of the Trial Judge would reveal that only three witnesses were examined till date of report. Considering the period of custody already undergone by the petitioner, let the petitioner above-named, be released on bail on furnishing bail bond of Rs. 20,000 (Twenty thousand)

Patna High Court CR. MISC. No.50216 of 2017(6) dt.09-04-2019 2/2 with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending in connection with Garkha P.S. Case No. 102/2015 corresponding to Sessions Trial No. 600/15, subject to the condition that both bailors shall be resident of territorial jurisdiction of the learned court below and further the petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
