Informant's minor daughter, Shabnaz Parvin was kidnapped on 26.09.2016 for which written report was filed on 30.09.2016 whereunder it has been disclosed that his (informant's) brother-in-law (Sala) had disclosed that he had seen Sumit who happens to be brother of the petitioner along with Bolero vehicle and further she (victim) accompanied Sumit and had gone over Bolero. From the order impugned, it is evident that case diary was called for and nothing substantial has been perceived against the petitioner. Status of the victim to be major or minor will relate with plea of Sumit with whom the victim had gone but so far this petitioner is concerned, for want of positive evidence to connect him with the crime, mere naming as one of the suspects will not

Patna High Court Cr.Misc. No.54307 of 2016 (2) dt.20-12-2016 justify his detention furthermore.

Accordingly, petitioner, Ramesh Chaudhary is directed to be released on bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of CJM, Begusarai in Dandari PS Case No.53/2016. (Aditya Kumar Trivedi, J) perwez U T
