ANSARI ORAL ORDER 21-05-2015 Both the applications, made under Section 438 of the Code of Criminal Procedure, seeking pre-arrest bail by the petitioners, namely, Lalan Tiwary (Cr.Misc.No. 4907 of 2015), Guddu Kumar Kewat and Mulani Sahni (Cr. Misc.No. 12046 of 2015) in connection with Ahiyapur Police Station Case No. 681 of 2014 under Sections 420/120(B) of the Indian Penal Code and Section 11 of the Public Gambling Act and Section 25(1-B)A/26 of the
Patna High Court Cr.Misc. No.4907 of 2015 (3) dt.21-05-2015 Arms Act, 1956.
Perused the above applications, materials available in the case diary and materials on record including a copy of the order, dated, 09.01.2015, passed, in A.B.P. No.2310/2014, 2329/2014, 2330/2014 and 19/2015, by the learned Sessions Judge, Muzaffarpur dismissing the said applications for pre-arrest bail. Heard Mr. Sangeet Deokuliar, learned counsel for the petitioners (in Cr.Misc.No.4907 of 2015), and Mr. Devendra Kumar, learned counsel for the petitioners (in Cr.Misc.No. 12046 of 2015). Heard also Mr. A.K.Jha, learned Additional Public Prosecutor, appearing on behalf of the State. Considering the fact that co-accused, Arjun Kumar and Nagendra Kumar @ Nagendra Sah, have been granted the benefit of pre-arrest bail by a Bench of this Court by order, dated 20.02.2015, passed in Cr. Misc. No.
6880 of 2015, it is hereby, in the interest of justice, directed that the petitioners above-named shall, in the event of their arrest in connection with the case aforementioned, be released on bail of Rs. 10,000/-, with two sureties of the like amount, subject to the satisfaction of the Officer-in-Charge, Ahiyapur Police Station, Muzaffarpur .
Patna High Court Cr.Misc. No.4907 of 2015 (3) dt.21-05-2015 appear before the Officer-in-Charge, Ahiyapur Police Station, and make themselves available for interrogation by police at all reasonable time and shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer.
This application for pre-arrest bail shall stand disposed of in terms of the above observations and directions. Let a copy of this order be sent, forthwith, to the Officer-in-Charge, Ahiyapur Police Station, District Muzaffarpur. .
