2. The petitioner seeks bail in connection with Asarganj P.S. Case No. 42/2025, registered for the offence under Sections 80(2), 238, 3(5) of BNS, 2023.

3. The accused/petitioner is named in the F.I.R. and is in custody since 11.03.2025.

4. The allegation against the petitioner is to cause death of daughter of the informant alongwith other co-accused persons/family members due to non-fulfillment of demand of dowry as raised for cash of Rs. 2 lacs, one golden ring and chain.

5. Learned counsel appearing on behalf of the petitioner submitted that the thrust of allegation is available against the

Patna High Court CR. MISC. No.51682 of 2025(3) dt.15-11-2025 2/3 husband of deceased, who is in judicial custody for the present. It is pointed out that being mother of the husband of deceased, the present petitioner implicated with this case without having any cogent material. It is pointed out that petitioner living separately with deceased and her husband and having no connection with their daily and domestic affairs. It is also pointed out that one of the co-accused, namely, Birendra Singh @ Ravindra Singh, who is brother-in-law of the deceased was already granted bail by one of the learned co-ordinate Bench of this Court through Cr. Misc. No. 59877 of 2025 dated 30.08.2025. While concluding argument, it is submitted that investigation of this case is already completed, for which charge-sheet has been submitted, as such, there is no chance of tampering with the evidence and, moreover, petitioner is a lady of clean antecedent.

6. Learned APP opposed the prayer of bail.

Considering the aforesaid factual submissions and by taking note of fact as the thrust of allegation to cause death of daughter of the informant is available against her husband, who is in judicial custody, coupled with the fact that investigation of this case is already completed, where petitioner being a lady of clean antecedent remains in custody since 11.03.2025, accordingly, petitioner above named, is directed to be released on bail in

Patna High Court CR. MISC. No.51682 of 2025(3) dt.15-11-2025 3/3 connection with Asarganj P.S. Case No. 42/2025 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-I, Munger/concerned Court, subject to the conditions as mentioned under Section 437(3) of the Cr.P.C./Section 480(3) of BNSS.
