The petitioner is facing prosecution in connection with Sitamarhi P.S. Case 415 of 2016 registered for offence under Sections 414/34 of the Indian Penal Code.
The Sub-Inspector of Police has lodged the present case. It is alleged that in course of chase of the vehicle on the way, one accused person was arrested at the spot and he disclosed the commission of theft of several motorcycles. On such disclosure, the house of the petitioner was searched and another stolen motorcycle was recovered from his possession. The petitioner is in jail custody since 28.06.2016.
Looking to the nature of allegation and the materials
Patna High Court Cr.Misc. No.47836 of 2016 (2) dt.10-11-2016 reflected from the case records, prima facie, it appears the petitioner is a member of a gang of motorcycle lifters. I am not persuaded to extend the privilege of bail of the petitioner. Accordingly, his prayer for bail is rejected. However, the petitioner shall have liberty to renew his prayer for bail after expiry of six months.
