2. The petitioner apprehends his arrest in connection with Rampur Choram P.S. Case No. 26 of 2025 for the offence registered under sections 115(2), 309(4) of the BNS, 2023 lodged on 25.03.2025 by the informant, Sonu Kumar.

3. As per the prosecution story, the informant while going to Gaya to pick up his relative on Scorpio, as reached Arwal Honda Showroom, unknown persons stopped and after negotiation of fare, they sat on it.

4. As the story unfolded, on the point of pistol, the Scorpio was looted and he was thrown out. Dial 112 was called which followed the FIR.

5. During the investigation, it was found that the car crossed a toll plaza with a changed vehicle no. BR02M-2500, the petitioner thereafter came in the police net and his version is

Patna High Court CR. MISC. No.55844 of 2025(2) dt.08-09-2025 2/2 that he is actually the owner with the said vehicle no. which was sent for repair and this changed vehicle was handed over to him. As such, he has no role to play in the alleged loot of the Scorpio.

6. Learned APP, Mr. Jitendra Kumar Singh on the other hand opposes the prayer submitting that it is not the case of the petitioner that a changed vehicle was given to him, he lodged the FIR.

7. Learned counsel for the petitioner submits that a complaint petition has been filed.

8. Considering the submissions of the parties as also the fact that the role of petitioner has come in the investigation, the alleged vehicle recovered having different registration plate, this petitioner has criminal antecedent, in that background, this Court is not inclined to extent him relief, which is accordingly rejected.

9. However, if the petitioner surrenders within a period of four weeks, the Court concerned shall take up the matter and dispose it of preferably on the same day. (Rajiv Roy, J) Vijay Singh/- U T
