The petitioner seeks bail in Complaint case No. 2098 of 2016 registered under Section 323, 406, 420, 467, 468, 120B & 504 but cognizance has been taken under Section 506, 323, 467/34 of the Indian Penal Code.

The own uncle of the petitioner is complainant. The complainant alleged that petitioner fraudulently sold the land of Khata No. 611, Khesra No. 2491 measuring nine decimal without having valid title.

The learned counsel for the petitioner submits that petitioner admitted his guilt and disclosed that on account of persuasion made by purchaser that his uncle died the petitioner

Patna High Court Cr.Misc. No.61390 of 2018 (2) dt.06-10-2018 2/2 executed the sale deed. The dispute is of civil nature and petitioner is in jail since 22.05.2018. The petitioner has already remained in jail for more than four months.

Considering the facts aforesaid and the nature of allegation made against the petitioner, the petitioner, above named, is directed to be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Muzaffarpur in connection with Complaint case No. 2098 of 2016.
