The petitioner seeks bail in a case registered for the offence punishable under Section 302 & 201/34 of the Indian Penal Code.
After hearing learned counsel for the parties, earlier vide order dated 25.06.2021, a report was called for regarding the stage of the trial and the time likely to be taken in conclusion of the trial. In compliance thereof, a report dated 30.06.2021 sent by the learned Additional Sessions Judge-III, Patna City, Patna, which is at Flag 'R' to this application, in which the learned Judge has, inter alia, stated that one year's time is required to conclude the trial after restoring the normalcy at the end of lock down.
Patna High Court CR. MISC. No.9301 of 2021(5) dt.28-10-2021 2/2 Having gone through the case record as well as the report of the learned Judge, I am not inclined to grant bail to the petitioner.
However, the learned Trial Court is directed to conclude the trial as expeditiously as possible preferably within one year from the date of receipt/production of a copy of this order. Both the parties are expected to extend their co-operation in conclusion of the trial. The Senior Superintendent of Police, Patna is directed to ensure production of the witnesses in the case on each and every date fixed without fail.
