2. Petitioners apprehend arrest in a case registered for the offence punishable under sections 341, 342, 323, 324, 325, 354B, 307, 379, 435, 427, 504/34 of the Indian Penal Code.

3. As per the prosecution case, on the alleged date and time of the occurrence, all the accused persons assaulted the informant and others by means of lathi.

4. It is submitted on behalf of the petitioners that specific accusation of assault is against co-accused Bhagirath Rai, Naresh Rai and Ravi Ranjan Kumar ( petitioner no.2) who are said to have assaulted daughter of the informant by means of

There is general and omnibus allegation against petitioner no. 1 and 2 and no specific overt act has been alleged against them. Injuries allegedly caused by these petitioners are simple in nature. After investigation, petitioners were not sent up for trial by the police. However, differing with the same, court below took cognizance of the case against these petitioners also. Charge sheet is already submitted. Several coaccused, with similar allegation, have already been allowed prearrest bail by a co-ordinate bench of this Court vide order passed in Cr.Mis.No. 18338/2025. Petitioners claim clean antecedent.

5. Learned counsel for the State opposes the prayer for bail.

6. Considering the aforesaid facts of the case, prayer for bail of all the petitioners is allowed. In the event of arrest/surrender within eight weeks from today, let these petitioners, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate IV Motihari, East Champaran in Trial No. 2022/2024, Kalyanpur Police Station Case No. 94/2020, subject to the conditions laid down under section 438(2) of the Code of
