JUSTICE DINESH KUMAR SINGH ORAL ORDER 29-06-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 341,323,504,506 and 384/34 of the Indian Penal Code and sections 3(1)(x) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act.

The accusation is of abusing by calling caste name, demanding extortion of rupees twenty thousand and assaulting the informant with fists and slaps.

It is submitted by the learned counsel for the petitioners that for the occurrence of 16.10.2014 the FIR was registered on 18.10.2014 and there is nothing on record to suggest that the

It is further submitted that the present case has been lodged in retaliation to the protest made by the petitioners against the informant for selling illicit liquor. Statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent.

Considering the delayed lodging of the case and the nature of accusation, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned JM Ist Class, Biharsharif (Nalanda) in connection with SC/ST P.S. Case No.98 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C.
