JUSTICE DINESH KUMAR SINGH ORAL ORDER 10-07-2015 Heard learned counsels for the petitioner and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 364, 302, 201 and 120B/34 of the Indian Penal Code.
The informant's younger brother went missing, subsequently his dead body cut into pieces was recovered. It is submitted by learned counsel for the petitioners that the certain articles were recovered on the confession of co-accused Gubri Rai who suggested that he received weapons for commission of the offence from Ram Dayal Paswan when Ram Dayal Paswan was also apprehended who also made confession
Patna High Court Cr.Misc. No.24818 of 2015 (2) dt.10-07-2015 2/2 but Gubri Rai and Ram Dayal Paswan did not name the petitioner. Initially, a Sanha was also lodged in which the petitioner was not named.
It is submitted by learned counsel for the informant that during investigation, several witnesses claimed to be eye-witness and they have suggested the name of the petitioners as they were taking away the dead body and considering the same, prayer for regular bail of other similarly situated accused Ganesh Rai has been rejected vide Cr. Misc. No. 16679 of 2015. Let the learned court below consider the prayer for regular bail of the petitioners if they surrender within a period of six weeks in connection with Maner P.S. Case No. 311 of 2014 pending in the court of learned JM, 1st Class, Danapur. Accordingly, the application is disposed of.
