JUSTICE SUDHIR SINGH ORAL ORDER 17-08-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted for the offence under Sections 302 and 201/34 of the Indian Penal Code. The prosecution case, in brief, is that two sons of Devendra Rai, namely, Pawan Kumar and Rohit Kumar had taken away the son of the informant for playing but he did not return home. The informant started to search her son and during search the informant and others found dead body of her son in a village pond.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 25.04.2016 and the charge sheet has been submitted in the present case. The petitioner has got no criminal antecedent. The petitioner is a house wife. She is not
Patna High Court Cr.Misc. No.25834 of 2016 (3) dt.17-08-2016 2/2 named in the F.I.R. She is a lady. After four months of the alleged occurrence certain witnesses have claimed to see the deceased along with the petitioner. Except for this, there is no other substantive evidence to implicate the petitioner in the present case.
On behalf of the State, it is submitted that the petitioner's name has come in course of investigation. Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Pupri at Sitamarhi in connection with Nanpur P.S.
