This application is for grant of regular bail in connection with Madhepura P.S.Case no.167 of 2018 dated 16.3.2018 for the offences under Section 379 of the Indian Penal Code.

There is allegation of theft of the motorcycle. The petitioner is not named in the FIR.

Submission of the learned counsel for the petitioner is that he has been made accused on the basis of confessional statement of the co-accused and nothing has been recovered though he is accused in one more case but he is on bail in that case. He is in custody since 29.5.2018.

Heard learned A.P.P. also.

Patna High Court Cr.Misc. No.58139 of 2018 (2) dt.08-10-2018 2/2 Having heard both sides and in view of the facts and circumstances, this application is disposed of with direction to the learned trial court that once he completes two more months in custody, he shall be released on bail in connection with Madhepura P.S.Case No.167 of 2018 to the satisfaction of the learned trial court with further condition that he will co-operate in disposal of the trial and will appear as and when required by the court concerned.

With the aforesaid observation, this application is disposed of.
