Petitioner prays for bail in connection with Shakurabad P.S.Case No. 98 of 2017 registered for the offences punishable under Sections 302/34 of the Indian Penal Code. This is a case of double murder, who were uncle and mother of the informant, and petitioner is not named in the FIR and later on his name transpires on suspicion as there is land dispute between the parties from before.

Submission of learned counsel for the petitioner is that except suspicion there is nothing against the petitioner and he is in custody since 29.6.2018.

Having heard both sides and in the facts and

Patna High Court Cr.Misc. No.58114 of 2018 (2) dt.08-10-2018 2/2 circumstances, this application is disposed of with a direction to the court below to verify as to whether charge sheet has been submitted or not and once charge sheet has been submitted in this case and if there is no other allegation except suspicion against the petitioner, he will be released on bail to the satisfaction of the court below itself.
