JUSTICE SHIVAJI PANDEY ORAL ORDER 05-10-2015 The order dated 24th September 2015 is modified to the extent that in place of "Bass Book" it be read as "Pass Book". Heard learned counsel for the petitioner and learned counsel for the respondent.

Generally, the Court does not pass the order against the petitioner in the contempt matter, but in the present case on 24th September 2015 the State has affirmatively stated that all payments have been credited to the account of the petitioner, but the petitioner always denied that no such payment has been made to him and no amount has been credited to his account, in tern, the Court directed to produce the pass book showing the latest entry therein and the Court also warned that if the payment has been credited to the account of the petitioner, the Court may pass suitable order, even against the petitioner.

Patna High Court MJC No.2585 of 2014 (7) dt.05-10-2015 2/2 Today an affidavit has been filed. From the record it appears that entire money has been credited to the account of the petitioner even then he has insisted that no money has been paid to him. The petitioner has given several excuses for making statement about such payment which is not acceptable to this Court when the Court itself has said to verify the account but the petitioner has always insisted that no payment has been paid to him.

In such view of the matter, this petition is dismissed with a cost of Rs.500/- which should be deposited in High Court Legal Services Committee, Patna.
