2. The petitioner has renewed his prayer for bail in connection with Cheriabariarpur P.S. Case No. 09 of 2016 having earlier been rejected by order dated 21.07.2016 in Criminal Miscellaneous No. 24657 of 2016.

3. Learned counsel for the petitioner submits that in a subsequent development, co-accused Mahesh Mahto has since been allowed to be released on bail after completion of nine months in custody from 22.02.2016, vide order dated 01.09.2016 passed in Cr. Misc. No. 28987 of 2016. It is stated that the petitioner's name had transpired on the extra-judicial confession of the said coaccused Mahesh Mahton. The petitioner has already completed for more than one year and three months in custody.

4. Be that as it may, having regard to the entirety of the facts and circumstances of the case, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Majhaul, District Begusarai in connection with Cheriabariarpur P.S. Case No. 09 of

Patna High Court Cr.Misc. No.54324 of 2016 (4) dt.03-05-2017 2/2 2016 with the following conditions:

(i) That one of the bailors shall be a close relative of the petitioner.

(ii) That the petitioner shall not indulge in any similar offence till conclusion of the trial.

(iii) That the petitioner shall remain physically present in court on each and every date during trial and in the event of failure on two consecutive dates without sufficient reason, his bail bond shall be liable to be cancelled by the learned Court concerned. (Vikash Jain, J) B.T/Chandran U T
