JUSTICE SUDHIR SINGH ORAL ORDER 17-08-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted for the offence under Section 392 of the Indian Penal Code. The prosecution case, in brief, is that on 13.04.2015 the informant along with his brother had gone to Central Bank of India, Bikramganj. His brother withdrew Rs.90,000/- from the bank and kept Rs.80,000/- in the plastic carry bag and Rs.10,000/- in his pocket. They arrived at the Registry Officer, Bikramganj and they were waiting for vendor, then some persons on two motorcycles arrived there and decamped towards Thana chowk after snatching the carry bag containing the aforesaid money. It has been submitted on behalf of the petitioner that the petitioner is in custody since 11.04.2016 and the charge sheet

Patna High Court Cr.Misc. No.26359 of 2016 (3) dt.17-08-2016 2/2 has been submitted in the present case. There is no allegation of tampering of witnesses against the petitioner. The petitioner is not named in the F.I.R. The petitioner has been made accused on his own confession before the police. No test identification parade has been held. There is no recovery of any incriminating article. On behalf of the State, it is submitted that the petitioner is not named in the F.I.R.

Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Bikramganj in connection with Bikramganj P.S.
