Petitioner is languishing in judicial custody since 12.10.2016 in connection with Muzaffarpur Rail P.S. Case No. 86/16 registered for the offence punishable under Section 30 of the Excise Prohibition Act, 2016.
The prosecution case, as lodged by the railway police, is that during course of duty they found two persons near the automatic stair-case and on being apprehended the petitioner was found possession 15 bottles of foreign liquor each containing 750 ml. Accordingly, seizure-list was prepared. It has been submitted by the learned counsel for the petitioner that he is innocent, bears no criminal history and has
Patna High Court Cr.Misc. No.54608 of 2016 (2) dt.22-12-2016 2/2 falsely been implicated in the aforesaid case. However, learned A.P.P. for the State submits that the petitioner is named in the First Information Report, hence, opposes the prayer for bail.
Be that as it may, since petitioner has no criminal history, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Railway Judicial Magistrate, Saran at Chapra in connection with Muzaffarpur Rail P.S.
