Petitioners are apprehending arrest in connection with a case registered for the offences under Sections 406, 409, 420, 467, 468, 471, 472, 120-B of the Penal Code in connection

Patna High Court Cr.Misc. No.12380 of 2015 (3) dt.22-05-2015 2/3 with withdrawal made from the account of petitioner Sarvind Kumar Thakur. Petitioner Manoranjan Jha is said to be instrumental in such withdrawal along with petitioner Sarvind Kumar Thakur. It is submitted on behalf of petitioner Manoranjan Jha that he has no account in the branch, as such, he is not responsible for any erroneous withdrawal made from the account of Sarvind Kumar Thakur.

Let petitioners, named above, surrender in the court below within a period of four weeks from the date of receipt/ production of a copy of this order in the Court below and thereafter petitioner Manoranjan Jha be released on bail on furnishing bail bond of Rs. 5,000/-(Rs. Five Thousand Only) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Darbhanga in connection with Darbhanga Town P.S. Case No. 277/2014, subject to the conditions laid down under Section 438(2) Cr.P.C.

So far petitioner Sarvind Kumar Thakur is concerned, his request for grant of bail be considered in the light of his offer to deposit the illegally withdrawn amount. In case, petitioner Sarvind Kumar Thakur is agreeable to deposit the amount in three instalment within a period of nine months he be released on provisional bail on furnishing bail bond of Rs. 5,000/-

Patna High Court Cr.Misc. No.12380 of 2015 (3) dt.22-05-2015 3/3 (Rs. Five Thousand Only) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Darbhanga in connection with Darbhanga Town P.S. Case No. 277/2014, subject to the conditions laid down under Section 438(2) Cr.P.C., provided he deposits Rs. 3 lakhs within one month. Provisional bail granted to petitioner Sarvind Kumar Thakur be confirmed only after deposit of the entire amount within a period of nine months.
