JUSTICE PRABHAT KUMAR JHA ORAL ORDER 12-06-2020 Heard learned counsel for the petitioner and the learned Additional P.P. through video conferencing. The petitioner seeks bail in Sessions Trial No.103 of 2017, arising out of Gopalpur P.S. Case No.193 of 2016, registered under Sections 364 and 34 of the Indian Penal Code. The prayer for bail of the petitioner was earlier rejected vide order dated 29.08.2018 with a direction to the trial court to conclude the trial within six months but the trial has not been concluded and thereafter the petitioner filed the present petition for grant of bail.

Report was called for from the 2nd Additional Sessions Judge, Naugachhia and from the Superintendent of Police, Naugachhia. The learned Additional Sessions Judge reported that the trial is likely to be concluded within three month vide

The Superintendent of Police, Naugachhia reported that all the prosecution witnesses were examined. The prosecution case was closed on 19.11.2019. The next date is 20.11.2019 for recording the statement of the accused. It appears that the trial has already been concluded. In view of the facts aforesaid, the prayer for bail of the petitioner is rejected.
