JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 13-09-2021 Heard learned counsel for the petitioner and learned APP for the State through virtual Court proceedings. The petitioner seeks bail in a case registered for the offence punishable under Sections 376/511 of the Indian Penal Code.

Allegation against the petitioner is that on 24.09.2020 at around 11.00 pm, he forcibly entered into the house of the informant and tried to commit rape with the informant. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. He further submits that there is dispute between the parties. The husband of the informant was Bataidar of the

Patna High Court CR. MISC. No.11506 of 2021(3) dt.13-09-2021 2/2 petitioner. The petitioner had not given land to the husband of the informant, therefore, the present case had lodged against the petitioner. The petitioner is languishing in judicial custody since 26.09.2020. The petitioner has got no criminal antecedent which is mentioned in para 3 of the bail petition. Charge sheet has been submitted in this case.

Learned APP for the State vehemently opposed the prayer for bail application and submits that Section 376 of the Indian Penal Code is made out against the petitioner. Considering the aforesaid facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) with two sureties of the like amount each in connection with Larayatarh @ Laraiyatanr P.S. Case No. 34/2020 to the satisfaction of learned Court below where the case is pending/ successor Court.
