JUSTICE DINESH KUMAR SINGH ORAL ORDER 05-08-2015 Petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 149, 323, 427, 504, 506 of the Indian Penal Code, Section 27 of the Arms Act and Section 3(1)(x) of the SC & ST (Prevention of Atrocities) Act.

It is alleged that accused persons abused the informant by calling caste name, made assault, gave life threatening and resorted to fire.

It is submitted by learned counsel for the petitioners that for the occurrence of 05.11.2014 the First Information Report was registered on 09.11.2014. There are several rounds of litigations pending between the parties from before. It is further submitted that for the same occurrence one Mahesh Sah lodged Ganga Bridge P.S. Case No. 117 of 2014

Patna High Court Cr.Misc. No.31558 of 2015 (2) dt.05-08-2015 2/2 against the petitioners and others wherein petitioners have already been granted anticipatory bail.

Considering the aforesaid facts, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with SC/ST(Hajipur) P.S. Case No. 39 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Dinesh Kumar Singh, J) Shageer/- U T
