====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 27-09-2024 Heard learned counsel for the petitioners and the State.
2. Petitioners apprehend arrest in a case registered for the offence punishable under sections 304B/34 of the Indian Penal Code.
3. It is a case of dowry death. Daughter of informant was married with one Rohit Kumar in May, 2019. Later on, her husband and his family members (petitioners herein) subjected her to cruelty and finally killed her by tiding rope in the neck.
4. Learned counsel for the petitioners submits that the petitioners are innocent and have falsely been implicated in this case. There is general and omnibus allegation against them and no specific overt act has been alleged against them, who happens to be in-laws of the deceased. It is further submitted that the petitioners are separate in mess and business. Thrust of allegation is against the husband of the deceased who is already in custody.

Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let these petitioners, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate I, Vaishali at Hajipur in Goraul (Kathara OP) Police Station Case No. 58 of 2020, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
