The petitioner seeks bail in a case registered for offences punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

It is contended that, as per allegation, 27 litres Nepali wine was recovered from cartoons which were being carried by there persons including the petitioner. It is urged that nothing was recovered from the conscious possession of the petitioner. It is further urged that the petitioner has falsely been implicated in this case due to dirty local politics. Petitioner claims that he is having clean antecedent and is in custody since 28.07.2018.

Patna High Court Cr.Misc. No.62685 of 2018(2) dt.08-10-2018 2/2 Having regard to the facts and the circumstances of the case, the abovenamed petitioner is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the 2nd Additional Sessions Judge-cum-Special Judge, Araria in connection with SPL Case No. 880/2018 arising out of Kursakanta (Sonamani Godam O.P.) P.S. Case No. 167 of 2018.

Further, if the petitioner, after his release in this case, is again found to be involved in similar nature of case then the court concerned would be at liberty to take steps for cancellation of his bail bond.
