The petitioner seeks bail in Jokihat (Mahalgaon) P.S. Case No. 212 of 2019 corresponding to Special Case No. 693 of 2019, registered for the offence punishable punishable under Section 30(A)/37(C) of the Bihar Prohibition and Excise Act, 2016.

Five litres of cough syrup has been recovered from co-accused apprehended on the spot who disclosed the name of this petitioner as one of his accomplices.

It is submitted that no recovery has been made from conscious possession of this petitioner and he has been made accused in this case on the disclosure of co-accused who was apprehended with cough syrup. Petitioner is in custody since

Patna High Court CR. MISC. No.62941 of 2021(2) dt.20-12-2021 2/2 01.05.2021. Investigation is complete.

Learned APP however vehemently opposed the prayer for bail and submitted that petitioner has got criminal antecedent and three cases of similar nature are pending against him. Considering the facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District & Sessions Judge II-cum-Special Judge Excise Act, Araria in connection with Jokihat (Mahalgaon) P.S. Case No. 212 of 2019 corresponding to Special Case No. 693 of 2019, once the charge is framed in the case.
