Petitioner seeks bail in a case registered under section 307 and other minor sections of the Indian Penal Code. According to the prosecution case itself, the firing of FIR named accused Manish Kumar hit on the leg of the informant. No doubt, there is allegation of indiscriminate firing against the petitioner and other accused but firing of the petitioner did not hit the informant. Petitioner does not have any criminal antecedent and is languishing in jail custody since 4.5.2016.

Case diary written up to 5.5.2016 has been received but the injury report of informant is not available on the case diary. The order of Addl. Sessions Judge goes to show that no injury report was brought before him at the time of consideration of bail application of the petitioner.

Considering the aforesaid facts and circumstances as well as

No.27186 of 2016 (3) dt.01-09-2016 submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of Sri Randhir Kumar, Judicial Magistrate, Ist Class, Danapur, Patna/ concerned court in Rani Talab P.S. Case no. 48/2016.
