Heard learned counsel for the petitioner and learned A.P.P. for the State through virtual mode.

The petitioner seeks regular bail in connection with Nadi P.S. Case No. 240 of 2022 lodged under Section 30(a) of the Bihar Prohibition and Excise Act.

As per the prosecution case, the recovery of 107 litres desi mahua wine was alleged to be made from the house of the accused Kedar Mahto.

Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Her name has figured in this case only and only due to the reason that she is the wife of the person from whose house the wine is alleged

Patna High Court CR. MISC. No.52100 of 2022(2) dt.14-10-2022 2/2 to be recovered. Learned counsel submits that petitioner is in custody since 15.06.2022, charge sheet has already been filed in this case. He submits that there is one criminal antecedent pending against her on which she is on bail and the said case was not of excise matter.

Learned counsel for the State opposes the prayer for bail.

In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge Excise, Patna City, Patna in connection with Nadi P.S. Case No. 240 of 2022, subject to the conditions as laid down under Section 437(3) of Cr.P.C.

With this observation, the bail application stands allowed.
