Petitioner seeks bail in connection with Khajekalan P.S. Case No. 59 of 2016 registered under Sections147, 148, 149, 341, 323, 307, and 302 of the Indian Penal Code. The allegation against the petitioner is that he along with other accused persons entered in the hosue of the informant and started beating the persons present there. Karu Paswan and his four sons started making indiscriminate firing and due to their assault, some persons belong to informant's side became injured wherefrom the injured were taken to hospital for treatment where Chhoto Paswan died. Learned counsel for the petitioner submits that

Patna High Court Cr.Misc. No.52987 of 2016 (2) dt.14-12-2016 allegation of firing is against Karu Paswan and his sons and there is no specific allegation against the petitioner. It is further submitted that similarly situated accused namely, Kallu Thathera @ Mallu Thathera @ Mukesh Kumar has been granted bail by this Hon'ble Court vide Cr. Misc. No. 31338 of 2016.

Considering the facts and circumstances of the case and the fact that similarly situated co-accused has been granted bail by this Court, the petitioner above named is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Patna City in connection with Khajekalan P.S. Case No. 59 of 2016.
