====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR SINHA ORAL ORDER 23-05-2022 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing for the State.
Petitioner seeks regular bail in connection with Rajpur P.S. Case No. 122 of 2021 registered for the offences punishable under Sections 304(B)/34 of the Indian Penal Code 1860 and Section 3/4 of Dowry Prohibition Act. As per prosecution story, the informant being father of the deceased has alleged that on 21.6.2021, he received information that the petitioner along with other accused persons have killed the daughter of the informant due to non-fulfillment of the dowry demand.
Learned counsel for the petitioner submits that the
Patna High Court CR. MISC. No.62967 of 2021(2) dt.23-05-2022 2/3 petitioner has not committed any offence in the manner alleged and he is father-in-law of the deceased. Learned counsel further submits that the entire family members have been made accused on the basis of general and omnibus allegation and the informant has also not disclosed that just before the occurrence, the petitioner had tortured the deceased for want of demand of dowry. The petitioner is in custody since 23.6.2021 and the charge sheet has already been submitted in the matter. Learned counsel also submits that husband of the deceased is in custody.
Regards being had to the submission made by the parties and taking into consideration the materials on record and the fact that allegation against the petitioner is general and omnibus in nature, petitioner is in custody since 23.6.2021 and the charge-sheet has already been submitted in the matter, I am inclined to grant regular bail to the petitioner.
Accordingly, let the petitioner, above named, be released on regular bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief
