JUSTICE NAVANITI PRASAD SINGH ORAL ORDER 22-05-2015 The petitioners apprehend their arrest in relation to Mainatand P.S. Case No. 46 of 2014 registered under Sections 379/34 of the Indian Penal Code for alleged cutting and concealing of green Seesam tree.

Learned counsel for the petitioners points out that petitioners are political supporter of one Ansul Azam who has rivalry to the informant in Panchayat Election. It is for this reason this false case has been instituted. The falsity is writ large from the fact that such a Seesam tree having been cut but no one is aware of it. They are produced by the informant himself

Patna High Court Cr.Misc. No.4520 of 2015 (3) dt.22-05-2015 before the police allegedly recovered by the informant from the saw-mill of the petitioners. Petitioners has no saw-mill.

Be that as it may, in the event of their arrest/surrender before the court below within four weeks, let the above named petitioners be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand only) with two sureties of the like amount each to the satisfaction of Sub-Divisional Judicial Magistrate, Bettiah, West Champaran, in connection with Mainatand P.S. Case No. 46/2014, subject to condition laid down under Section 438 (2) of the Code of Criminal Procedure.
