The petitioner seeks bail in connection with Nokha P.S. Case No. 129 of 2022, dated 16.04.2022, instituted for the offences under Sections 399, 402, 120(B) and 34 of the Indian Penal Code and Sections 25(1-b)a, 26 and 35 of the Arms Act.

The petitioner was apprehended on the spot in police raid and from his possession, a country made pistol and live cartridges were recovered.

It has been submitted on behalf of the

Patna High Court CR. MISC. No.52099 of 2022(2) dt.23-12-2022 2/2 petitioner that he is in custody since 16.04.2022. It has further been submitted that out of five cases in which he was made accused earlier, three are such cases in which has been made accused on the basis of the confession of other accused persons and in all such cases, the petitioner is on bail.

Regard being had to the nature of accusation and the period of custody of the petitioner, he, namely, Vivek Kumar @ Munna Kumar @ Munna, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Sasaram in connection with Nokha P.S. Case No. 129 of 2022. The application stands allowed.
